What is ACA-5?
The California Constitution, pursuant to provisions enacted by the initiative Proposition 209 in 1996, prohibits the state from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting. The California Constitution defines the state for these purposes to include the state, any city, county, public university system, community college district, school district, special district, or any other political subdivision or governmental instrumentality of, or within, the state.
The present ACA5 is the 5th amendment to the Constitution initiated by the House of Representatives in California. It was initiated by Sherley Weber, a democratic representative in San Diego, who proposed that California Proposition 209 be repealed by a referendum in 2020. Its predecessor, SCA5, was the 5th amendment to the Constitution of California proposed in the California Senate (Senate Constitutional Amendment) in 2012, aiming to delete any references to “public education” in the Proposition 209. By doing so, it essentially asked public universities to consider such factors as race, gender and ethnicity in their admission operations. That is to say, schools and universities in California may adopt a race-based admission policy in the future. This amendment was rejected with the joint efforts of many organizations and individuals.
